Terms & Conditions

Full terms & conditions+

These terms govern all projects between Weblify Designs ("we", "us", "our") and you ("client", "customer"). By engaging our services you agree to these terms.

1. Scope of Work

Every project begins with a written scope document (email or message) covering deliverables, timeline, and price. Any work outside the agreed scope requires a separate quote.

2. Pricing & Payment

Prices are quoted in South African Rand (ZAR) and exclude VAT unless stated otherwise. Payment terms are 50% upfront, 50% on delivery unless agreed otherwise in writing. Late payments may result in work being paused until payment is received.

3. Revisions & Changes

Each project includes two rounds of reasonable revisions. Additional change requests or scope creep may be charged at our standard hourly rate. Major changes after approval may require a new quote.

4. Timeline & Delivery

Estimated timelines are provided in good faith. Delays caused by third-party services (hosting, payment gateways, APIs, AI model availability) or late client feedback are not our responsibility. We will communicate any expected delays promptly.

5. Client Responsibilities

  • Provide all required content (text, images, branding, product info) within agreed timeframes
  • Respond to feedback requests within 5 business days — otherwise the project proceeds with what's available
  • Ensure you have the legal right to use any content, trademarks, or third-party assets you provide

6. Intellectual Property

Upon full payment, you own the final delivered work (website code, automation workflows, designs). We retain the right to display the work in our portfolio unless agreed otherwise in writing. We do not claim ownership of your content or data.

7. Third-Party Services

Projects may involve third-party platforms (n8n, Google Workspace, Shopify, payment gateways, hosting providers, AI APIs). We are not responsible for their uptime, pricing changes, or policy changes. Any ongoing subscription fees for these services are your responsibility.

8. No Guarantee of Specific Results

We build websites and automations to the agreed specification. We do not guarantee specific business outcomes such as sales figures, lead volumes, or search engine rankings. Results depend on many factors outside our control.

9. Liability

Our total liability is limited to the amount paid for the specific project giving rise to the claim. We are not liable for any indirect or consequential losses, including loss of profit, data, or business interruption, even if advised of the possibility.

10. Confidentiality

We treat all client information as confidential and will not share it with third parties except as necessary to deliver the project (e.g. hosting support). We may use anonymised data for internal analytics and improvement.

11. Cancellation & Refunds

You may cancel a project at any time. You will be billed for work completed up to the cancellation date. A refund of the upfront payment is only available if no work has commenced. Custom automation workflows and software are non-refundable once built.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be handled in the courts of Johannesburg, South Africa.

13. Changes to These Terms

We may update these terms at any time. The latest version is always available on this page. Continued engagement after changes means you accept the updated terms.
